Joshua Berman is a partner in Meltzer, Lippe, Goldstein & Breitstone’s litigation group. Josh’s practice focuses on complex commercial litigation, with an emphasis on expedited multi-forum disputes, corporate governance/ M&A matters, securities litigation, real estate litigation, insurance litigation, SEC and internal investigations and contract claims.
Josh has represented a broad range of Fortune 500 companies and other entities in industries including private equity, investment banking, real estate, telecommunications and pharmaceuticals. Josh has also represented, among others, debtors-in-possession and commercial lenders in complex real estate and industrial bankruptcies and restructurings.
Prior to joining Meltzer Lippe, Josh served as a law clerk to the Hon. Rosemary Barkett (U.S. Court of Appeals for the Eleventh Circuit) and was associated with Kasowitz, Benson, Torres & Friedman, LLP and Debevoise & Plimpton, LLP.
Josh is a cum laude graduate from Harvard Law School where he was a member of the Harvard Civil Rights – Civil Liberties Law Review.
Josh has provided representation in the following engagements:
- Counsel to investment bank in breach of contract action arising out of $100 million sell-side advisory engagement.
- Counsel to Fortune 500 insurance and financial services company in Market Timing and Late Trading investigation by the SEC and New York Attorney General.
- Counsel to NYSE-listed insurance and financial services company in civil RICO litigation against alleged enterprise consisting of short-selling hedge funds and corrupt securities analysts.
- Counsel to individual members of an LLC formed to acquire and develop tracts of real estate in New York, in connection with dissolution of LLC and dispute concerning ownership interests.
- Counsel to private-equity sponsor group in connection with $10.3 billion acquisition of building supply business, which had been jeopardized by the lenders’ threats to breach their financing commitments.
Josh lives in New York City with his son, Zachary. In his spare time Josh enjoys playing drums in a jazz band.
